In a Supreme Court ruling on December 3, Rt. 2024-2211-A, the Supreme Court concluded that the 76 square meter pier at Hjellestad was not a notifiable measure under the Building Act 1965 § 84. Thus, the state lost the case, and the municipality must chart a way forward. In the panel, we discuss the case complex, but also what will be important to remember in future cases of illegal follow-up.
